Sub:DENY ENTRY TO KAMAL NATH FOR HIS ROLE IN MASSACRE OF SIKHS IN NOVEMBER 1984.

INITIATE CRIMINAL PROSECUTION OF KAMAL NATH UNDER BELGIUM LAW FOR CRIMES AGAINST HUMANITY

Honorable Prime Minister:

Kamal Nath, India's Minister for Urban Development is scheduled to attend and address 5th EuroIndia Summit on October 13, 2011 in Leuven, Belgium. On behalf of Sikh community, we urge you to initiate criminal prosecution of Kamal Nath under Belgium law for crimes against humanity and deny Nath’s entry into Belgium for participating in Massacre of Sikhs during November 1984.

It is a matter of official record {Justice Nanavati Commission Report-2005} that Kamal Nath was in control of the mob that attacked Gurudwara (Sikh Temple) Rakab Ganj in Delhi on November 01, 1984 in which many Sikhs were burnt alive. Kamal Nath admits being present at Gurudwara Rakab Ganj at the time of attack. {Under Oath Statement of Kamal Nath to Justice Nanavati Commission}.

A United States Federal Court has issued summons to Kamal Nath in a Tort Claim case “Sikhs for Justice et al., v. Kamal Nath (10-cv-2940)(S.D.N.Y.) based on the overwhelming evidence of Nath’s involvement in massacre of Sikhs in 1984.

Belgium, its government, legislature and its people are very sensitive to the issue of human rights abuses and genocide. Belgian people’s sensitivity on the issue of genocide and human rights is reflected in Belgium’s unique law that provides for the prosecution of the crimes of Genocide and war crimes even when such crimes take place outside Belgium. Through this law, Belgium has successfully prosecuted individuals responsible for Genocide in Rawanda.

To allow Nath to enter Belgium will therefore be contrary to the Belgium’s commitment to uphold Human Rights around the world and in violation of Belgian law while requires prosecution of individuals like Kamal Nath who have participated in the crimes against humanity. Kamal Nath’s entry will become a black spot on Belgium’s impeccable record of commitment to human rights and will violate Belgium’s long held position on “Crimes Against Humanity”. A killer like Kamal Nath has no place alongside Belgian leaders and citizens who have always carried the flag of human rights.

We strongly demand that Kamal Nath should be banned from entering into Belgium permanently and instead Belgium should initiate criminal prosecution of Kamal Nath for his role in massacre of Sikhs in November 1984.
